General Terms of Sale and Use (T&Cs)
1. Purpose
These general terms govern the contractual relationship between Catch and Cook Adventures (SARL KMJ), hereinafter referred to as “the Company,” and any person, hereinafter referred to as “the Client,” wishing to book an excursion or use the services offered via the website www.catchandcookadventures.com, through online booking platforms, or directly with the manager.
Booking a service implies full and unconditional acceptance of these general terms and conditions.
2. Services Offered
Catch and Cook Adventures offers private boat excursions around Raiatea and Taha’a, including but not limited to:

Lagoon and/or offshore fishing

Lagoon and coral garden exploration
-
Cultural visits (deserted beaches, vanilla farms, etc.)

Preparation and tasting of meals on board or onshore
Descriptions of the available services are provided on the website.
3. Booking and Payment

Bookings can be made via the website, through booking platforms, by email, or by phone.

A deposit (the amount of which is specified at the time of booking) may be required to confirm the reservation.

The balance is payable on the day of the excursion, unless otherwise agreed.

Payments can be made by credit card, bank transfer, or any other method accepted by the Company.
4. Prices

Applicable prices are those listed on the website on the date of booking.

Prices are expressed in XPF, € or $, and include applicable taxes.

The Company reserves the right to modify its prices at any time; however, services will be invoiced at the rate in effect at the time the booking is confirmed.
5. Cancellation and Modification Policy

Any cancellation by the Client must be notified in writing (email).

Cancellation less than 24 hours before the scheduled date or failure to show up: the deposit will be retained by the Company.

In the event of unfavorable weather conditions or force majeure, the Company reserves the right to cancel or reschedule the excursion. In such cases, the deposit will be fully refunded, or an alternative date will be offered to the Client.
6. Client Obligations

The Client agrees to follow all safety instructions given by the crew.

Minors must be accompanied by an adult.

The Client must inform the Company of any specific medical condition that may require adjustments to the activity.

Any deliberate damage to equipment or failure to comply with instructions may result in additional charges.
7. Liability

The Company uses all necessary means to ensure the safety and smooth running of excursions.

However, participation in activities is under the Client’s own responsibility.

The Company cannot be held liable for indirect damages, losses, theft of personal belongings, or the consequences of external events (e.g., weather conditions, sea state).
8. Insurance
The Company is covered by professional liability insurance for the organization of its activities. Clients are advised to have their own travel insurance covering nautical activities.
9. Intellectual Property
All content of the website (texts, images, photos, videos, logo, etc.) is protected by intellectual property rights.
Any reproduction, even partial, is prohibited without prior written authorization.
10. Personal Data
Data collected during bookings is used solely for service management and will never be shared with third parties without consent.
The Client has the right to access, rectify, and delete their data, in accordance with current regulations.
11. Governing Law and Jurisdiction
These terms and conditions are governed by the laws of French Polynesia.
Any dispute will be subject to the exclusive jurisdiction of the Tribunal of Papeete.
